Welcome to CaloBuddy! These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "user") and CaloBuddy ("we", "us", or "our"), governing your access to and use of the CaloBuddy mobile application, website, and related services (collectively, the "Service").

1. Acceptance of Terms

By downloading, installing, accessing, or using CaloBuddy, you confirm that you are at least 13 years old (or the minimum legal age in your jurisdiction) and that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Medical & Health Disclaimers (Important)

CaloBuddy does not provide medical advice, diagnosis, or treatment.

  1. Informational & Educational Purposes Only: All content, tools, calorie calculations, macronutrient breakdowns, meal estimates, and virtual pet feedback provided by CaloBuddy are for general informational, wellness, and self-monitoring purposes only.
  2. Not a Healthcare Provider: CaloBuddy is not a licensed medical device, healthcare provider, registered dietitian, or certified personal trainer. The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition (including, without limitation, eating disorders, diabetes, obesity, or metabolic conditions).
  3. Consult Your Physician: Always seek the advice of a physician or other qualified healthcare provider before beginning any diet, weight management plan, fasting protocol, or exercise program, particularly if you are pregnant, nursing, elderly, or have pre-existing medical conditions.
  4. Assumption of Risk: Your use of the Service and reliance on any information provided is entirely at your own risk.

3. AI Meal Analysis & Nutritional Accuracy Disclaimer

  1. Approximation Nature of AI: CaloBuddy utilizes artificial intelligence (including Google Gemini API) and external nutritional databases to analyze meal photos, voice inputs, and text descriptions. Nutritional values, portion sizes, ingredients, and calorie counts generated by the AI are estimates and approximations only.
  2. No Guarantee of Accuracy: We do not warrant or guarantee the accuracy, completeness, reliability, or correctness of any food recognition, calorie estimate, or macronutrient value.
  3. Allergens & Dietary Restrictions: CaloBuddy is not an allergen detection tool. Never rely on the Service to determine whether a food contains allergens, gluten, toxins, or ingredients that could cause adverse reactions. You are solely responsible for inspecting and verifying the safety of all food and beverages you consume.

4. User Accounts & Security

  1. Registration: To access certain features, you may be required to create an account using email or a third-party authentication provider (e.g., Google, Apple). You agree to provide accurate and complete information.
  2. Account Security: You are solely responsible for safeguarding your login credentials and for all activities that occur under your account. You must notify us immediately at chris.calobuddy@gmail.com if you suspect any unauthorized access.
  3. Account Termination & Suspension: We reserve the right to suspend or terminate your account at our sole discretion, without prior notice or liability, if you violate these Terms, engage in fraudulent activity, or abuse the Service.

5. Virtual Credits, Purchases & Strict Non-Refundable Policy

5.1 Virtual Credits and In-App Items

CaloBuddy may offer in-app virtual currency ("Credits", "Tokens"), ad-skip features, virtual pet items, badges, or premium subscriptions (collectively, "Virtual Items").

  • Current Store Build: This current release does not sell Premium subscriptions directly in the store build. If paid subscriptions are offered later, they will be billed through Google Play / Apple App Store and these terms will apply.
  • Limited License: Virtual Items are licensed to you on a limited, personal, non-exclusive, non-transferable, revocable basis solely for use within the CaloBuddy app.
  • No Real-World Value: Virtual Items are not real-world currency, property, or monetary instruments. They cannot be redeemed, exchanged, or converted into real money, goods, or services from us or any third party.
  • Rate Limits & Fair Use: Virtual Credits (e.g., used to skip ads or run extra AI analyses) do not waive platform safety rules, daily fair-use limits, or service quotas.

5.2 Strict Non-Refundable Policy

⚠️ NON-REFUNDABLE PURCHASE POLICY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL PURCHASES OF VIRTUAL CREDITS, TOKENS, PACKS, DIGITAL CONSUMABLES, AND SUBSCRIPTIONS ARE FINAL AND STRICTLY NON-REFUNDABLE.

Once a purchase is completed and credits or items are credited to your account:

  • No refunds, chargebacks, or credits will be issued for unused, partially used, or expired Virtual Credits.
  • No refunds will be provided if your account is terminated or suspended due to a violation of these Terms.
  • If you choose to delete your CaloBuddy account, all remaining credits and Virtual Items are permanently forfeited without reimbursement or compensation.

5.3 Billing & Third-Party Platforms

  • Purchases made through app stores (such as Google Play or Apple App Store) are processed directly by the respective platform under their payment terms. Any refund requests permitted exclusively by mandatory platform statutory rules must be submitted directly to the app store provider.
  • We reserve the right to modify prices, credit pack sizes, and availability of Virtual Items at any time without prior notice.

6. User Content & Intellectual Property

  1. User Content: You retain full ownership of the photos, meal notes, text, and personal data you upload to the Service ("User Content").
  2. License to CaloBuddy: By uploading User Content, you grant CaloBuddy a worldwide, non-exclusive, royalty-free, revocable license to host, store, transfer, display, process, and analyze your User Content solely for the purpose of operating, maintaining, and providing the Service to you (including transmission to AI analysis providers like Google Gemini).
  3. CaloBuddy Intellectual Property: All software, design, logos, UI/UX elements, gamification concepts (including the CaloBuddy virtual pet models, sound assets, and badges), trademarks, and copyrights are the exclusive property of CaloBuddy and its licensors. You may not copy, modify, distribute, reverse-engineer, decompile, or extract source code from the Service.

7. Acceptable Use & Prohibited Conduct

You agree that you will not:

  • Use the Service for any unlawful, fraudulent, or abusive purpose.
  • Upload any content that is offensive, harmful, harassing, sexually explicit, defamatory, or infringing on third-party rights.
  • Attempt to circumvent, tamper with, or manipulate daily quotas, credit balances, security systems, or billing mechanisms.
  • Use automated bots, scrapers, or scripts to access or harvest data from the Service.
  • Reverse-engineer, decompile, disassemble, or derive the source code of the app or backend APIs.
  • Engage in toxic, abusive, or deceptive behavior in community feeds, squads, or social challenges.

8. Third-Party Services & Links

The Service integrates with third-party providers (such as Supabase for database/storage, Google Gemini for AI analysis, and Google AdMob for optional rewarded ads). We are not responsible for the availability, terms, or privacy practices of these external services. Your interactions with third-party providers are governed by their respective terms.

9. Disclaimer of Warranties ("AS IS")

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW:

  1. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
  2. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
  3. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  1. IN NO EVENT SHALL CALOBUDDY, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, HEALTH COMPLICATIONS, ALLERGIC REACTIONS, OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
  2. OUR AGGREGATE TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE STRICTLY LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU TO CALOBUDDY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY UNITED STATES DOLLARS ($50.00 USD / EQUIVALENT IN MYR), WHICHEVER IS LESS.

11. Indemnification

You agree to defend, indemnify, and hold harmless CaloBuddy, its officers, directors, contractors, and employees from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

  • Your access to or use of the Service;
  • Your User Content;
  • Your violation of these Terms or any applicable laws or regulations;
  • Any misrepresentation made by you.

12. Governing Law & Dispute Resolution

  1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.
  2. Informal Resolution: In the event of any dispute, claim, or controversy, you agree to first contact us at chris.calobuddy@gmail.com and make a good-faith effort to resolve the dispute informally.
  3. Jurisdiction: If an informal resolution cannot be reached within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of Malaysia.

13. Changes to These Terms

We may update or modify these Terms from time to time. When we make material changes, we will notify you through the app (such as via a banner or update prompt) and update the "Last Updated" date at the top of this document. Your continued use of CaloBuddy after any changes constitutes your acceptance of the revised Terms.
